1. Acceptance of Terms

By accessing or using SkySMS services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

SkySMS provides an SMS API platform that allows users to send text messages programmatically. Our services include single SMS delivery, bulk messaging, OTP services, and related features.

3. Account Registration

To use our services, you must:

  • Create an account with accurate information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have legal capacity
  • Notify us immediately of any unauthorized access

4. Acceptable Use Policy

You agree NOT to use our services to:

  • Send spam, unsolicited messages, or bulk marketing without consent
  • Transmit illegal, harmful, or offensive content
  • Impersonate others or provide false information
  • Interfere with or disrupt our services
  • Violate any applicable laws or regulations
  • Send messages to numbers without proper consent
  • Engage in phishing or fraudulent activities

Important: Anti-Spam & Abuse Policy

Your account is continuously monitored. The following may result in immediate suspension or permanent ban:

  • • Spam — Sending unsolicited or mass spam messages
  • • Multiple Accounts — Creating multiple accounts to target the same recipient
  • • Fraudulent Activity — Using the service for scams or fraud
  • • Harassment — Sending threatening or abusive messages
  • • Illegal Content — Distributing illegal or harmful content
  • • API Abuse — Excessive requests or system manipulation

We use automated detection systems. Suspicious patterns are flagged and reviewed. Violators will have accounts banned and API keys deactivated without warning.

5. Credits and Payments

  • Credits are non-refundable once purchased
  • Each SMS message costs 1 credit
  • Failed messages do not consume credits
  • Subscription plans are billed monthly/annually as selected
  • We reserve the right to change pricing with notice

6. API Usage

  • API keys must be kept confidential
  • Rate limits apply (60 requests per minute)
  • We may suspend access for abuse or violations
  • API availability is provided "as is" without guarantees

7. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for any losses due to service interruptions.

8. Limitation of Liability

SkySMS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the past 12 months.

9. Termination

We may suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may also close your account at any time. Upon termination, unused credits are forfeited.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of Metro Manila.
